1. Introduction

This Privacy Policy regulates the collection, storage and processing of personal data related to the business of KF Finance d.o.o. and the operation of the website www.kf-finance.si.

Personal data is processed in accordance with Regulation (EU) 2016/697 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (the "General Data Protection Regulation"), applicable Slovenian legislation on the protection of personal data and other legislation that provides us with a legal basis for processing of your personal data.

This Privacy Policy is provided in order to inform you about the basis and purposes of the processing of personal data by KF Finance d.o.o. and the content and your rights in this area, in accordance with the requirements of the General Data Protection Regulation, as well as with the information regarding cookies when using the website www.kf-finance.si, which is managed by KF Finance d.o.o.

2. Who is the controller of your personal data, who are the recipients and other information regarding contractual processing

Controller of personal data is company KF Finance d.o.o., Verovškova cesta 55a, 1000 Ljubljana, +386 59 059 057, info@kf-finance.si (hereinafter: KF Finance d.o.o.).

KF Finance d.o.o., as the controller of personal data, obtains personal data from individuals in the following ways:

• from individuals who have filled out a contact form on www.kf-finance.si;
• directly from individuals who have provided KF Finance d.o.o. with contact personal data in the context of a business relationship;
• from individuals visiting the www.kf-finance.si website (cookies). 

Recipients of personal data are employees of KF Finance d.o.o. and contractual partners of KF Finance d.o.o. as processors, who are obliged to respect and protect the personal data of individuals on the basis of the employment law regulation and a processing of personal data agreement pursuant to the General Data Protection Regulation.

1. On what legal basis do we process personal data?

a) Processing on a lawful basis

KF Finance d.o.o. processes personal data on the basis of the applicable regulations governing the protection of personal data, which provide an appropriate legal basis for the processing of personal data.

b) Processing of personal data based on the consent of the data subject

KF Finance d.o.o. processes the data for which you have given your consent for the purposes specified in the consent.

The conclusion of a contract with KF Finance d.o.o. is not conditional upon the consent. Giving consent is voluntary and if you decide not to give the consent or subsequently withdraw it, this shall in no way diminish your rights arising from your business relationship with KF Finance d.o.o.

c) Processing of personal data on a contractual basis

The processing of personal data is necessary for the performance of a contract to which data subject is a party, to whom the personal data relate or to take action at the request of such neutral person before entering into a contract.

d) Processing based on legitimate interest

KF Finance d.o.o. may process personal data on the basis of legitimate interest, but only if, after a careful assessment, the interests of the company are not overridden by the interests or fundamental rights and freedoms of the data subject.

2. How do you withdraw your consent?

Consent is given only for the purposes specified in the consent and is valid until the consent is withdrawn. If you withdraw your consent in whole or in part, KF Finance d.o.o. will no longer use your data for the purposes for which you have withdrawn your consent.

If you wish to withdraw your consent, you may do so by sending a request to info@kf-finance.si. KF Finance d.o.o. will record your request for withdrawal and, if possible, enforce the withdrawal immediately, or, if this is not possible, within 14 days of receipt of the withdrawal of consent.

3. What data do we collect and for what purposes do we process it?

By filling in the form on the website https://www.kf-finance.si you provide KF Finance d.o.o. with the following personal data: first name, last name, company, telephone, e-mail address. We need this contact information to process your message and to communicate with you.

All data and information collected is processed by KF Finance d.o.o. for the purpose of responding to your enquiry.

4. Information on transfers of personal data to a third country or an international organisation

KF Finance d.o.o., as the controller, does not transfer your personal data to any third countries (outside the member states of the European Economic Area – i.e. EU member states and Iceland, Norway and Liechtenstein) and to any international organisations.

5. How long do we keep your data?

The period of retention of personal data depends on the basis of the processing and the purpose of the processing of each category of personal data. We keep personal data only for as long as is necessary to achieve the purpose for which the personal data were collected or further processed.

The personal data that you provided to us when sending the contact form on the website https://www.kf-finance.si are kept until withdrawal, or in accordance with applicable law. All other personal data within the framework of contractual cooperation are kept in accordance with the applicable legislation (the deadline from the contractual relationship is the statute of limitations according to the Code of Obligations).

Your personal data will not be disclosed by transmission to third parties (except to contract processors).

7. The rights of the data subject

KF Finance d.o.o. guarantees you the exercise of your rights regarding the processing of your personal data without undue delay and in any case within 14 days of receipt of the request, unless the regulations set out a shorter period.

If there is reasonable doubt as to the identity of the data subject making the request in relation to any of his or her rights, KF Finance d.o.o. may request the provision of additional information necessary to establish or confirm the identity of the data subject.

You have the following rights under the General Data Protection Regulation:

• The right of access to personal data
  If you wish to obtain information about the personal data held about you by KF Finance d.o.o., you have the right to request the following information from KF Finance d.o.o.:
  • the purpose of the processing,
  • the recipients of the personal data,
  • the envisaged period of retention of the personal data or, if this is not possible, the criteria to be used to determine that period,
  • where the processing of personal data is based on the personal consent of the data subject, the existence of a right to withdraw consent at any time,
  • in the event that the personal data have not been collected from the data subject, all available information concerning their source,
  • the right to lodge a complaint with the Information Commissioner,
  • the existence of the right to request access from KF Finance d.o.o.,
  • the rectification or erasure of personal data or the restriction of the processing of personal data concerning the data subject, the existence of a right to object to such processing,
  • the existence of a right to data portability.

• Right to rectification:
  You have the right to obtain from KF Finance d.o.o. without undue delay the rectification of inaccurate or incorrect personal data concerning you. You have the right to have incomplete personal data completed, including by means of providing a supplementary statement.

• Right to erasure:
  You have the right to have your personal data erased by KF Finance d.o.o. without undue delay, and KF Finance d.o.o. is obliged to erase your personal data without undue delay where one of the following grounds applies:

  • the personal data are no longer necessary in relation to the purposes for which they were collected or otherwise processed,
  • the data subject withdraws consent on which the processing is based and where there is no other legal ground for the processing,
  • the data subject objects to the processing and there are no overriding legitimate grounds for the processing,
  • the personal data have been unlawfully processed,
  • if the law so provides.

• Right to restriction of processing:
  You have the right to obtain from KF Finance d.o.o. restriction of processing where one of the following applies:

  • the data subject contests the accuracy of the data for a period which allows KF Finance d.o.o. to verify the accuracy of the personal data,
  • the processing is unlawful and the data subject opposes the erasure of the personal data and requests the restriction of their use instead,
  • KF Finance d.o.o. no longer needs the personal data for the purposes of the processing, but they are required by the data subject for the establishment, exercise or defence of legal claims,
  • the data subject has objected to processing pursuant, pending the verification whether the legitimate grounds of the controller override those of the data subject.

• Right to data portability:
  You have the right to receive the personal data concerning you that you have provided to KF Finance d.o.o. in a structured and readable form and you have a right, if it is technically feasible, to have that data transmitted by KF Finance d.o.o. to another controller where the processing is based on written consent and where the processing is carried out by automated means.

• Right to object:
  As a data subject whose processing is necessary for legitimate interests, you have the right to object to such processing. In this case, KF Finance d.o.o. shall no longer process the personal data unless we can demonstrate compelling reasons for the processing which override the interests of the data subject. As a data subject whose personal data is processed for direct marketing purposes, you have the right to object to such processing, in which case KF Finance d.o.o. shall no longer the personal data for such purposes.

• Right to lodge a complaint with a supervisory authority.
